Terms of service
What we agree to do, and what we do not promise.
These terms cover Delphi Monitor, operated by Phantasm and Brain. They are written in the same plain language as the rest of this site, and every clause describes something the product actually does rather than something a template says it might. Last changed 5 September 2026.
What you are buying
A measurement service, billed monthly, that you can stop at any time.
- The service
- Delphi Monitor puts the buying questions your customers ask to five AI assistants, records what each one answers word for word, scores where your brand stands, and on the levels that include it, names the work most likely to move that position. What is included at each level is set out on the pricing page, which is the only place those figures live.
- Levels and allowances
- Starter, Growth, Agency, Enterprise. Each level includes a number of brands you may hold and a number of measurement runs per brand per calendar billing period. An unused run does not carry over: the allowance resets when the period does. Additional single runs may be bought at any time from a paid level, and there is no limit on how many.
- A free reading
- The Demo level is arranged with a person rather than bought. It is a conversation and a first measurement, and nothing is charged for it.
- Who may spend
- An account holder with the owner or admin role may change the level, open the billing settings and buy an extra run. Everybody else in the organisation can use the product and cannot spend its money. You choose who holds which role when you invite them.
Payment
Monthly, in advance, by card, through Stripe. We never see or hold your card.
- How it is charged
- The card you enter at checkout is charged when you subscribe and on the same day of each month afterwards, until you cancel. The payment page is Stripe’s own and the card details are held by Stripe. They do not reach us and we could not store them if we wanted to.
- Tax
- Prices are shown before tax. Any VAT, GST or sales tax that applies is calculated at checkout and appears on your invoice.
- If a payment fails
- You keep your level, and everything already measured, for 7 days while the card is sorted out. New measurements pause during that window, because a run costs us real money the moment it starts. We email you when the payment fails and again before the window closes. If it is still unpaid after 7 days the account moves to the free level and nothing you have measured is deleted.
- Changing level
- You can move up at any time and the difference is charged straight away. You can move down once per billing period and the unused part of what you paid is returned as credit against your next invoice. Both take effect immediately.
- Questions about a charge
- Write to contact@delphimonitor.com within 60 days of the invoice and we will look at it. Refunds and cancellation are set out on the refunds page.
Your account
- Keeping it secure
- You are responsible for what happens under your sign-in. Choose a password you use nowhere else, and tell us promptly if you think somebody else has it.
- Your team
- Anybody you invite acts on behalf of your organisation, within the role you gave them. Their use is your responsibility.
- Your data stays yours
- You keep every right in the brands, questions and material you bring, and in the measurements taken for you. We hold them to run the service for you and to keep it working. We do not sell them, and we do not use one customer’s measurements to advise another.
How we measure, and what that means for the sites we read
Delphi reads public web pages. It says who it is while doing so.
- Your own site
- By naming a website in a workspace you confirm you are entitled to have it read. Delphi fetches public pages, identifies itself as DelphiMonitor with a link to the method, and obeys robots.txt. Where a site refuses it, that is reported to you as a finding rather than worked around.
- Sites you do not own
- Rivals are measured from what the assistants say about them and from their public pages, read the same way and under the same rules. Nothing private is accessed and nothing is purchased or transacted anywhere.
- Fair use
- Do not use Delphi Monitor to break the law, to infringe somebody else’s rights, to probe or overload the service, or to resell measurements as your own product without agreeing that with us first. Agencies measuring on behalf of named clients are exactly what the higher levels are for and need no separate permission.
What we do not promise
- Not an outcome
- Delphi tells you where you stand and what is most likely to help. It cannot commit to what an AI assistant will say next, because nobody controls that. Any range of expected improvement shown in the product is stated as a range with its basis, and it is an estimate rather than a commitment.
- A measurement is a sample
- Assistants do not answer identically twice. Every figure Delphi shows carries the uncertainty around it, and a movement smaller than that uncertainty is reported as not yet a result. That is deliberate, and it is explained in full on the methodology page.
- Third parties can be unavailable
- The five assistants are other companies’ services. When one of them will not answer, the run says so on its face rather than quietly filling the gap. We do not promise every assistant will answer every time.
- The service can be interrupted
- We aim to keep Delphi Monitor available and we do not promise it will never be down. If something we did causes you to lose a paid measurement, tell us and we will replace it.
- Our liability
- Nothing here limits liability for anything the law does not allow to be limited, including fraud, or death and personal injury caused by negligence. Beyond that, and to the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the twelve months before it arose, and neither side is liable to the other for lost profits, lost revenue or indirect losses.
Ending it
- You, at any time
- Cancel from Settings in the product. You keep the level you paid for until the end of the period you have paid for, then the account moves to the free level. Nothing you have measured is deleted, and resubscribing puts it all back.
- Us, rarely
- We may suspend or end an account that breaks these terms, that we are required to stop serving, or whose payments have failed and stayed unpaid. Except where something serious or unlawful is happening, we will tell you first and give you a chance to put it right.
- Getting your data out
- Every workspace exports as CSV and as a document from inside the product, at any level, including after a cancellation. If you want everything at once, or you want it deleted, write to contact@delphimonitor.com and see the privacy page.
The rest
- Changes to these terms
- We may change these terms. If a change matters to you, meaning it affects what you pay or what you get, we will email everyone with an account before it takes effect. The date at the top of this page always says when it last changed.
- Changes to the product
- Delphi Monitor is developed continuously. Surfaces move and measurements improve. Where a change alters how a figure is produced, the product marks the point it changed rather than letting a chart imply a movement that was really a method change.
- Law
- These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, and the courts there have jurisdiction. Before either side goes anywhere near a court, write to us: almost everything is a misunderstanding that an email fixes.
